New Patriot Act Provision Creates Tighter Barrier to Officials at Public Events

WASHINGTON A new provision tucked into the Patriot Act bill now before Congress would allow authorities to haul demonstrators at any "special event of national significance" away to jail on felony charges if they are caught breaching a security perimeter.

Sen. Arlen Specter , R-Pa., chairman of the Senate Judiciary Committee, sponsored the measure, which would extend the authority of the Secret Service to allow agents to arrest people who willingly or knowingly enter a restricted area at an event, even if the president or other official normally protected by the Secret Service isn't in attendance at the time.

The measure has civil libertarians protesting what they say is yet another power grab for the executive branch and one more loss for free speech.

"It's definitely problematic and chilling," said Lisa Graves, senior counsel for legislative strategy at the American Civil Liberties Union , which has written letters to the chairmen and ranking members of the House and Senate Judiciary Committees, pointing out that the provision wasn't subject to hearings or open debate.

Some conservatives say they too are troubled by the measure.

"It concerns me greatly," said Bob Barr, former U.S. prosecutor and Republican representative from Georgia. "It clearly raises serious concerns about First Amendment rights."

But not everyone agrees that rights are being trampled on by the additional provision. In fact, some say the ACLU is the problem when it comes to protecting national security.

Rocco DiPippo, a freelance writer for the conservative FrontPageMagazine.com and editor of The Autonomist Web log , said the ACLU has fought the government every step of the way over security measures following the Sept. 11, 2001, terror attacks.

"Its opposition to Specter's reasonable proposal is simply more of the same," he said. "I can understand the concern that we should be suspicious of government, but we shouldn't adopt this mindset: 'government is evil.' This is just more hatred of (President) Bush."

Under current law, the Secret Service can arrest anyone for breaching restricted areas where the president or a protected official is or will be visiting, but the new provision would allow such arrests even after those VIPs have left the premises of any designated "special event of national significance." The provision would increase the maximum penalty for such an infraction from six months to one year in jail.

In a post-Sept. 11 world many non-political events have been designated National Special Security Events and would rise to the higher status. Examples of possible NSSEs are the Olympics or the Super Bowl. In 2004, the presidential inaugural balls and President Ronald Reagan's June funeral procession in Washington, D.C., were designated NSSEs.

According to government sources with knowledge of the legislation, Secret Service protection and law enforcement authority would extend beyond protecting a specific person, rather the event itself would become the "protectee."

Currently, non-violent demonstrators who enter restricted areas at such events previously would be arrested and charged by local law enforcement with simple trespassing, said Graves. Under the provision included in the new law, they will be charged with felonies by the Secret Service.

"It's a different consequence to people," she said.

"You are talking about giving the executive branch broader authority to create these exclusion zones which could cover broad areas and last for days [during an event ]," David Kopel, a constitutional expert with the Cato Institute, told FOXNews.com.

A spokesman at Specter's office said the senator was surprised by the clamor over the provision, which merely makes a technical change to clear up legal confusion over who has arresting authority at NSSEs. His office had no further comment on the provision. Committee Ranking Member Sen. Patrick Leahy, D-Vt., also declined comment. Republican and Democratic House Judiciary Committee leaders did not return calls for comment.

White House sources say the measure was not instigated by the administration and pointed out that it was a stand-alone bill that was rolled into the Patriot Act by Specter's office during House-Senate conference negotiations. White House spokeswoman Dana Perino told FOXNews.com that the White House would not comment on the intent of the measure, but that the president is concerned with preserving individual rights.

"President Bush is committed to protecting the American people's national security as well as their civil liberties," she said.

Secret Service representatives said the agency does not comment on pending legislation.

The Bush administration has been criticized in the past for what many say are tactics that keep protesters far away from official events and by employing stringent policies to ensure favorable audiences for the president.

Last year, three ticket-holding audience members at one of the president's Social Security events in Denver, Colo., were apprehended by a man who they said identified himself as Secret Service. The three were forced away from the event because of an anti-war sticker on the driver's car.

"[The administration] has certainly demonstrated a desire to have carefully-controlled events," said Graves.

John Pike, director of GlobalSecurity.org, an Alexandria, Va.-based clearinghouse for domestic and international security information, said he "could certainly understand why the Secret Service would want that legal authority," given the enormous burden of making venues safe for VIPs today.

"However, I think many people have concluded that the way it is being used has nothing to do with protecting the president from Usama bin Laden and everything to do with suppressing dissent and making sure the protesters don't get on TV," Pike said.

Bush is not the first president to flex his authority in this area, said Kopel, who pointed out that beginning with Reagan, presidents have created a larger security bubble and greater distance between themselves and dissenters at public events. The 2001 terrorist attacks on the United States just intensified the situation, he said.

"I think the concerns about free speech in areas where the president is speaking long pre-date Bush. They were an issue in the Clinton administration, the first Bush administration and began as an issue during Reagan," Kopel said. "I do think the ACLU has legitimate concerns about the breadth of the new language and how it could be applied."

Graves points out that conservative "pro-life" groups will be the target of the new provisions, too, a scenario that could raise the concerns for those who are typically critical of the ACLU, which she said is necessarily concerned about other provisions in the bill that impinge on civil liberties.

House and Senate leaders, who return to Capitol Hill this week, are trying to renew the Patriot Act by Friday. Democrats and four Republicans in the Senate who filibustered a final vote in December after raising concerns about preserving civil liberties instituted a short-term extension of the previous bill, which was set to expire on Dec. 31.

I , for one, think Mrs. Sheehan did a brave and serious thing. I would not have attempted to hang a protest sign in a session of the Congress, but I do not fault her for it. I believe she is conducting a peaceful demonstration (if she unfurled a banner at all) and as far as her attire goes, that is none of my business nor the President's. The gallery isn't just for suits and gowns. She was invited. (Sounds like "E.T." doesn't it?). I reject sniping at her over etiquette or failure of reverence for buildings. If the Neocons had the slightest things for what Americans respect and revere, we wouldn't be where we are today: engaged in an invasion. The only thing we are on the offense about is offense against our own civil liberties.

She is wearing a more formal attire and carrying what appears to be a rolled up t-shirt in her hand. Are we ashamed of our commitment to spread democracy throughout the world - a commitment which unfortunately calls for the ultimate sacrifice?

How, may I asked, is Ms Sheehan's action disrespectful and criminal? I would think if one does not have the noblest cause for engaging our men and women in war, then one would feel desperately threatened by such emotional "branding", so to speak, and would perhaps, "legally" restrain one from such display. And you did just that, Mr. Bush and Co., with your overt contempt and disdain for the citizens of this country by the removal of Ms Sheehan from your State of the Union address.

Who would have thought that one mother could instill so much fear, in so many, with her truthful expressions of sorrow for those who have sacrificed their lives for your "noble" war?

I sent a letter to the MSNBC folks condemning the phrasing of their poll question.

They're calling a shirt that simply states the number of fallen as "an anti-war slogan".

My argument: that's no more an "anti-war" statement than the crosses at Arlington Cemetary are.

She simply was honoring the number of fallen heroes; a number that of course wasn't mentioned in the president's speech, much to his shame.

If Cindy Sheehan was an invited guest of a member of Congress, which seems clear, then to have arrested her for wearing an anti-war T-shirt is an outrage. If she were hanging a banner (how would she have gotten it through security to begin with?) that's a different story, because there's a specific rule against hanging banners; though even then, the remedy would be to take the banner away, not to arrest the person trying to hang it.

I'd be willing to bet the banner-hanging story was an after-the-fact excuse for an arrest that never should have happened. Somebody high up realized a bad mistake had been made and tried to save face.

This will backfire on the White House, mark my words. Cindy Sheehan isn't your garden-variety hippie who uses gutter language and smells bad. She's a grieving mother. This isn't good for Bushie.

One related point about the MSNBC poll that asked whether Cindy Sheehan's protest was legitimate or not.

Everyone knows these polls aren't scientific. But not everyone knows that Republican trolls are hired to send in votes on a non-stop basis. There's no screening, so Karl Rove's minions simply vote in favor of the administration without stopping. Sort of like Florida in 2000 and Ohio in 2004.

First time I checked the vote was 53-47 in Cindy Sheehan's favor. Now it's 51-49 the other way. Just like Ohio, except this time voting more than once is legal.

Cindy Sheehan is the face (albeit brutal face that even mom has a hard time loving) of the democrat kook fringe party. I feel her loss in Iraq, but she is not the only one who has lost a loved one. Some of us lost loved ones in the Towers on 9/11 and in the War on Terror also, and at least those lost in Afghanistan or Iraq died for SOMETHING. To have been murdered on 9/11 without any warning is a loss. At least those that have bravely fought and died in Iraq or Afghanistan took some bad guys with them.

Face it, dems are weak on defense and would rather be in power than defend America. Secretly, I think most dems want another attack to try and capitalize on it politically. For the record, I think the Republican wife who was asked to leave (but not arrested or roughed up) was quite correct to call the guy an "idiot" for escorting her out.

Civil liberties are non-partisan. If a Republican wants to wear a T-shirt that says, "Iraq is a noble effort," that's perfectly O.K., at the U.S. Capitol or anywhere else. A suspicion lingers that the reason the Republican woman was asked to leave was that Cindy Sheehan had already been arrested, and the Bushies wanted to pretend that her arrest was in accordance with some regulation, which was not the case.

In other words, it was a staged event...like the speeches on aircraft carriers and like all recent State of the Union messages by presidents of both parties. Orchestrated hype...and done dare call it statesmanship, not even a Congressman's wife of the same party.

I may not personally know Casey or Cindy Sheehan; however, I can assume the same is the case for you. To pull out of Iraq now as Cindy wants would diminish the death of her son because the conflict would not be resolved and we would be back where we began. Now is not the time to argue over the validity of the war in Iraq. The decision was made. We now must finish what we started. When all is said and done we can look back and learn from any mistakes we did or didn't make. As citizens of a country with our solidiers fighting for us we must now support them and pray that as many as possible come home safe.

Forgot the name of the author, but he is a war correspondent that has seen war first hand and knows it's detriment to man and society. I could go on and on. Joe seriously get some help before you hurt someone or yourself. It sounds like you have ADD or Dyslexia.

That's right, I don't know Casey Sheehan: which is precisely why I don't presume to know how he felt about the war, which is what you are doing.

How exactly would it "diminish" the death of her son to withdraw. This is a fallacy. He and all the soldiers, marines, and national guard in Iraq are doing their job and following orders - that in itself is honorable. It is the commander-in-chief who is at fault here. He is the one who is dishonorable to the military and the nation.

Complete and immediate withdrawal is not my prefered strategy. It is a valid concern for many none the less. To suggest that those who call for it are "hurting our resolve" or some such nonsense is counter-common sense. We live in a free country, or did you forget.

This is exactly the time to argue the validity of the war. The very basis for the war is illegal. There is no basis for us ever invading the country - escalating the violence further does not make us any safer.

A decision was made, based on falsehood and distortion of facts. To continue on the same path based on those grounds is nothing short of foolish.

"We must finish what we started". What does that mean, we must press on until every Iraqi is dead?

"Look back and learn from any mistakes we did or didn't make." If it isn't clear to you by now what mistakes have been made, kindly eject yourself from this debate. This story has been told over and over throughout history. The ending is never pretty.

Supporting our troops and demanding that the Commander-in-Chief change his failed policy go hand in hand. The president is unfit to lead the nation, let alone the strongest military in the world.

The Bush administration is operating under the goal of eliminating terrorism in the world. Whether you agree with this stance or not, there is no arguing that this is what his goal is. Following 9/11/01, Afghanistan became one of the targets in this mission because of its affiliation with Osama bin Ladin. We are currently still occupying Afghanistan because of violence still present in the area. To leave now would be an irresponsible act on our part towards the Afghani citizens.

Similarly you can look at the situation in Iraq. We entered Iraq as part of the war against terrorism. While the arguments presented for entering this war may not satisfy you completely (never will everyone be satisfied by every decision someone in power makes) there is no arguing that Sadaam Hussein was in fact terrorizing a majority of the population he was leading. Whether you feel this was something the United States should take on does not matter at this point as it has already been done. Due to the insurgencies in Iraq currently, our withdrawal would lead to further problems in Iraq just as happened following Desert Storm. While continuing the war may not make us any safer at this point here in America, as the most powerful country in the world it is our responsibility to the citizens of Iraq to finish what we started. This is a global society that we live in and we should not abandon our fellow citizens of the world.

Each American soldier who has fought in Iraq is also fighting for the freedoms of the Iraqi people. To withdraw from Iraq and risk the possibility of the Iraqis once again loosing this freedom would diminish the death of any soldiers that fought and died in Iraq. In America we have the privilege of being given the freedoms we have. The rest of the world should have the same chance that we have.

Blatant agreement or disagreement on the basis of the person leading the country is an abuse of our freedoms. We need to use this freedom to carefully analyze the situation and not blatantly speak out against a person because we are from a different party. The cause you fight for will be much more supported if you remain reasonable throughout your efforts instead of jumping off the deepend.

In case you didn't hear, a Republican Congressman's wife was wearing a pro-war shirt and she was asked to leave the speech also. She said she took her coat off because she was hot walking up the stairs from the bathroom. Why did she pee with her coat on? Why did she have to stand up to take her coat off? To make a statement. She's said in the past that civil disobedience is her next step. This was an act of it.

If he made his statement based on a report from an officer that he did not verify, then the OFFICER must be FIRED and the Chief reprimanded for making the public statement.

Either way, when new information is out, it must be SWARMED to the WaPo (an evil piece of &^%$ paper in the hands of Bush appeasers).

This is the BIG LIE that was quickly put out to the press to try to make this story go away.

WE MUST FIGHT THE BIG LIE EVERY TIME THEY TELL IT!!! EVERY SINGLE TIME!!!

This was done, because Rove didn't want the chance that a TV camera might show Cindy (with or without a shirt) when Bush talked about the sacrifices of the parents of dead soldiers.

From my perspective, Bush let the biggest terrorists, Bin Laden, Zawahiri, and the rest of Al Qaeda get away with their crimes when he went on an adventure in Iraq, which a) did not have weapons of mass destruction, and certainly not ones that they could deploy in 45 minutes (if it did, Israel would have taken them out much sooner), b) was not an imminent threat to its neighbors (if they were, Iran and Saudi Arabia would have acted much sooner), and c) had no formal connections to Al Qaeda (but I'm sure they do now, thanks George).

You can say that entering Iraq was a part of the "war on terrorism" all you want, but reality does not agree with you. We were lied into a war, as shown by the downing street minutes, which was a part of the plan put forth by neoconservative ideologues dating back to the early 90's.

Preemptive invasion was never a sane strategy in dealing with Iraq. But it was done. The ground war was won quickly, and we took Saddam out of power. We should have immediately withdrawn after that, and put in an international peacekeeping force. We didn't do that. We handed sovereignty over to the Iraqis and they drafted a constitution. We should have withdrawn our military and corporate interests immediately after that. We didn't. 2,245 dead americans, 16,000 wounded, and 30,000 dead civilians later and Iraq's oil production is lower than it was pre-war, their infrastructure is still destroyed, the Iraqi army is still disloyal and undertrained, and there's no end in sight. Again I ask you, what is our goal in staying until "we finish the job"? does that mean we don't leave until every last Iraqi is dead?

The fight for Iraqi's freedom ended when Saddam was toppled. They are a democracy now, with all the elections and corruption that go along with it. Freedom is theirs to lose. It's time for us to get out.

The most realistic and pragmatic thing we can do now is follow John Murtha's plan. Redeploy to neighboring allied countries. Get our people out and work on humanitarian aid. Use diplomacy to compel insurgents to drop their arms, take part in government, and keep terrorists out.

I am from no party. My criticism comes from my opposition to past and present policies. This is not the time in history to "go along to get along".

For any "middle of the road'ers who might have wandered into BradBlog... (because I wouldn't waste my time talking to AZ Joe or Jim in Iowa)...

1. The President of the United States wiretapped American Citizens (perhaps tens of thousands of them) without a court order, even though there was a TOTALLY SECRET COURT (FISA) that he could have gone to and they have given permission in every single case but 4 (of thousands). This should frighten you. Oh, and if they say they couldn't do that because it was an emergency, well, that is a LIE, because there is a provision that allows them to start the wiretap immediately and then apply for the court order AFTER THE FACT within 72 hours.

There are only two possible reasons why the President would allow these wiretaps to be performed without the legally required court permissions: Either, he is totally insane and believes himself to be a KING who is above the law. (Hmmm, I recall the Republicans talking a lot about "nobody is above the law, even the most simple and basic laws" when they put Clinton on trial.) or, the wiretaps were being performed on members of congress, the media, and other ordinary citizens and the President and his Republican Administration knew that the court would deny them these wiretaps.

There is no other reason that comes to mind for ignoring a legal method of doing what he wanted.

2. 100% of the money Abramoff gave to members of congress went to Republicans. 100%. Were some of Abramoff's clients Indian Tribes that had traditionally donated to Democrats? Yup. Did they continue to donate to Democrats even as they hired Abramoff (who turned out to be ripping them off)? Yup? Did Abramoff every ask them to? Nope. Did he ever parlay those donations into any positive benefit for himself or his clients like he did the donations that went 100% to the Republicans and to Bush? Nope. The Abramoff Scandal is 100% a Republican scandal.

3. Our "reason" for going into Iraq was never "to fight the war on terror" until after the WMD's that were promised were not found. Not just "suspected" WMD, but "absolutely established" WMD's. Why were they not discovered? Because they were not there? Why did we THINK they were there? Because the Pentagon's Office of Special Plans had killed every piece of intelligence that said they were probably not there and replaced it with false intelligence that said they definitely were. We were SPUN into this war and they continue to spin the war. Was Saddam a dictator? Yup. Was getting rid of him without breaking the country up into three separate chunks an incredibly stupid idea? You know it. BTW, had the American People been told that we were going into Iraq to "remove a horrible dictator and free the people of Iraq so they can have Democracy" then the polls would have been 80% opposed and 20% in favor and the congress would NEVER have gone along. That is why the "mushroom clouds" and "tons of toxic weapons" and WMDs and supporting terrorists and yellowcake from Niger had to be given as the excuse. The war in Iraq was a spun lie that squandered the support that the USA had to take down the Taliban in Afghanastan and attempt to capture OBL. We went from being supported in the world with a massive amount of "spendable capital" to morally bankrupt on the world stage. Good going Mr. President, that will make the global war on terror MUCH easier to win.

Republicans only see what they are told to see. It's really sad. And, even if I thought that Republicans were lazy, non-intellectual, single-minded, bigoted, and resentful sloths not worthy of air, I wouldn't use it an my reply to one of their arguments --- I would just keep it in mind as I communicate with them (or, better yet, ignore them).

For those Republicans who still consider themselves to be "open minded" and "thinking" I invite you into dialogue about what your current leaders in Congress and the President are doing to your party of "fiscal conservatism" and "compassionate conservatism." And if you are a member of the middle class, I ask you to consider the effect of this borrow-and-spend Administration with their Republican Congressional enablers on our future national security as our debt spirals out of control.

I don't believe that Democrats are perfect, but for heaven's sake, if you can't see the damage that the Republicans in power are doing to our country, then you are not looking very closely.

I was recently given an old documentary made in 1974 call 'Hearts and Minds. This doco was a chronical of the Viet Nam 'war' Police Action. I was so stunned after I watched it. I was not one of those that followed that war. I was not what I consider 'awake' during that time. I was happy living my life, working, ala...Wonderland. This documentary really made me understand why there are Viet Nam vets that are so supportive of this war. Many young men were interviewed for the film and they talked about the excitement of watching the bombs explode, never thinking much about the people that were dying as a result of their deeds. When I see Viet Nam holding their signs in support of the killing in Iraq, I now have some understanding of their mindset. I needed to see this film. My Father was a WW11 Vet, greatly opposed to Viet Nam. He could see through the bs in the 60's and didn't want his only son to die there.

My brother came home, my husband's brother did not, he died in the Tet Offensive, Westmoreland's idea of making himself a 'resounding victory', in 1968. Viet Nam was a contrived war just like Iraq, using the Gulf of Tonkin 'invasion' as it's pretex. I know many here know this, but I have not really studied Viet Nam. I now understand the great division between the Veterans for Peace and those that love war. Those that love war will sacrifice their children to lies, they have not yet risen to the level of understanding of the part they played in history. Perhaps their ego's will not let them come face to face with themselves. People are very complicated and each one of us 'arrives' on our own time schedule. Many will repeat the mistakes they have made, over and over again. Many cannot utter the words, 'I was wrong', 'I made a mistake'. I became free the day I gave myself permission to change my mind. My first time here, and my, what an interesting group. It seems we have both extremes present which can make for good debating, or not so good debating. Or simple baiting. And a bit of the "M" word, as well.

I think that the national debate has not captured what is really going on. We have one side arguing for the removal of tyrants, nuclear safeguarding, spreading democracy, and so on. The other side is arguing blood for oil, lies, etc. Both sides are guilty of looking at the world with "short-term" glasses.

The long term view requires stepping back and looking at what is happening in terms of decades, of centuries. This has nothing to do with saving Iraqis or lying for corporate cronies. This is about creating a dynasty that will change the course of history and render the players historical figures forever on par with Caesar, Alexander, Napoleon, and yes, even Hitler. As with "MeinKampf" or "Letters from a Birminham Jail", there are writings from the major players going back decades that describe exactly what they have in mind. They intend to create a world run by America.

The first step in this is to secure the remaining oil reserves by controlling land areas. We will never fully leave Iraq. We are constructing bases there and we'll stay for decades. The land has been seeded with enormous amounts of uranium. That, I think, is just a side "bonus" in that it rids the land of inhabitants and makes it easier to control. (In ten years, that land will be uninhabitable).

As this is the end of an age (the age of oil), it is the perfect time to sieze world power. The remaining steps include completion of the securing of the remaining fuel to economically control the world, total military domination with nuclear weapons (we have restarted a mini-nuke program), deter the rise of a global challenger, seize space as a military objective, and consolidate military and economic control into a "Pax Americana" for the foreseeable future.

2000 dead is a speed bump compared to these kinds of plans. Liberation of an oppressed people is nothing more than a means to an end. Admirable, yes, but the driving force? No.

Will protests make anything happen? Not likely. The men driving this road aren't really interested in what we think. They have bigger fish to fry. Will we be liberating the next "most oppressed people" found in several African nations? No. Will we allow Iran nukes? No. Will we abide by the nuclear non-proliferation treaty that tries to eradicate these weapons? No. The only things that will happen in America are those that further the plans for reaching global domination.

Am I a conspiracist? Before you answer that, read the writings of Cheney, Rumsfield, Wolfowitz, and about a dozen other members of the administration. But frankly, not George Bush. Bush is not the problem. He's the patsy, the frontman, and eventually the fall guy if needed. Read Breszinski's "Grand Chessboard" for a blueprint. After you look at all the written evidence for yourself, I'd be interested in knowing how one can come to any other conclusion.

Wiretapping - internal dissent is the source of most of the downfall of leaders (et tu, Brute?) and must be monitored. The constitution presents a problem with this, but I believe they think bending of the constitution is forgivable as long as the goal is virtuous. Pax Americana, as run by them, appears to be the virtuous goal. Many americans agree with that although they are not aware of the true goal. They think its terrorism.

The Supreme Court is another coup for this group. I think we will see an allowance of governmental powers far exceeding reasonable powers as a direct result of these 2 appointments. Is it insurance that their plans will not be derailed by "laws that were written for another time".

I have written some simple programs and it is quite simple to put one thing on the screen and another in the database. Our final tallies no longer match the exit polls. The exit polls have been dead nuts on for 200 years. We even cited the exit polls as proof of election fraud in Chechnya (?). Those exit polls are not wrong. The machines are. It doesn't matter who runs. If they can skew the pre-election polls about 5 points, and they can skew the results 5 points, they can control any election. We would need about a 70/30 cut to beat this system. We can't get 70/30 because the base, the Christian groups that are aligned with these men see the American global dynasty as a return to the rule of God. They will not be swayed by simple arguments of constitution or law because they are answering to a higher power. The end justifies the means for them. As such, we will not be able to vote them out of power.

However, I do think that there are men that have the desire and the resources to change history. That has always been true, and it is true today. And strangely, I actually think that they are doing it from a position of benevolence. I think they believe that they are the men most qualified to take the reins. In 200 years, given the rate of space exploration and technology, it is reasonable to think that the entire earth will be under the control (not iron thumb) of something. The preamble to "Rebuilding America's Defenses" states the reason for taking these steps is to project America's principles and interests around the world.

You piqued my interest when you said that Cheney was the hitman but not the boss. Who is the boss?

Now, the argument is advanced here (not really advanced, just bellowed) that a moral equivalency hasn't yet been reached between aborted fetuses and deaths in Iraq, i.e., until the death toll in Iraq equates with the unborn babies who have been aborted (an unknown total), the occupation may continue.

Does this mean that before abortion became legal, the war in Iraq would have been wrong...but now that abortion is legal, the war in Iraq is O.K.?

In fact, that's what Mr. Diggler is saying. Somehow I think he's wrong there.

She is wearing a more formal attire and carrying what appears to be a rolled up t-shirt in her hand. So she was likely ready to display the shirt or in the act of holding it up when she was arrested.
